Tommy Hilfiger files trademark infringement suit for protection of clothing products

Tommy Hilfiger Europe has filed a trademark infringement suit in the High Court of Delhi, accusing Originals Clothing of using ‘Tommy Hilfiger’ trademark on t-shirts, wallets, shirts and other clothing products sold by them. The plaintiff, who is engaged in designing and manufacturing high-end apparel for men, women and children, and a wide range of other licensed products such as footwear, accessories, fragrances and home furnishings under the brand name ‘Tommy Hilfiger’ has more than 1600 retail stores worldwide in about 115 countries.

Further, the plaintiff has various registrations in India with regarding trademarks ‘Tommy Hilfiger’, ‘Tommy’, ‘Tommy Sport’ and the unique logo in a combination of blue, white and red colour. The plaintiff had appointed an independent investigator to conduct a detailed investigation to ascertain the extent of the defendants' infringing products and found that the defendants are selling products identical to the plaintiff’s registered trademarks and have shown themselves as a ‘wholesale and retail distributor of Tommy Hilfiger’. The selling of the inferior quality products of their registered brand can cause irreparable loss to the plaintiff.

Justice Subramonium Prasad of the Vacation Bench granted an ad-interim injunction to the plaintiff and restrained the defendants from using the ‘Tommy Hilfiger’ mark. The matter is listed for hearing before the Roster Bench on 14th July 2021.
