SYSKA Led Lights accused of design infringement

GM Modular Pvt. Ltd. is a Mumbai-based firm that produces a variety of electrical products, including switches. GM Modular filed an action against SYSKA LED Lights for claimed infringement of its registered design before the District Court in Saket, New Delhi. GM Modular claimed that in 2016, it created a one-of-a-kind LED surface light and registered it under the Design Act of 2000. GM Modular further claimed that its goods with the aforementioned design are an immediate hit in the market and that it has made significant sales from 2016 to date with its goods with the

said design. The Hon'ble Court said in the ex-parte interim ruling that SYSKA's goods seem to be an apparent replica of the Plaintiff's registered design when judged only by the eyes. In addition, the Court ruled that since the Defendant's piece is similar to the Plaintiff's product, innocent customers may mistake the Defendant's piece for the Plaintiff's. As a result, the Hon'ble Court has barred Syska from using the GM Modular design on its product until further orders are issued.
