Spotify opposes trademark Opstify

Spotify AB, a corporation based in Stockholm, Sweden filed a Notice of Opposition against Opstify Corporation for their service mark ‘Opstify’ which have been applied for goods/services concerning ‘business management consulting’. Spotify was founded in 2006 to develop and offer software and services for streaming music and other multimedia content. It has promoted and offered software for streaming and managing music, podcasts, and videos through its website spotify.com since 2008, through which users can access music,

podcasts and other content at the website or by downloading their software to a computer, tablet, or mobile device. They have even provided services throughout the US and has developed valuable goodwill concerning the mark. With almost 350 million active users, and over 70 million songs, their services are offered to approximately 170 countries worldwide. The famous ‘Spotify mark’ is widely recognized and considered distinctive by the general public. Spotify filed the present opposition as they feel registration of the mark ‘Opstify’ can damage their registered mark Spotify's reputation. The use of the mark ‘Opstify’ can cause confusion or mistake among the public as they can get confused and assume that ‘Opstify’ in some way is connected/sponsored/affiliated with Spotify.

As Spotify is not associated with ‘Opstify’ in any way, they have prayed the trademark application concerning the mark 'Opstify' be rejected, and the present opposition be sustained in favour of Spotify.
