ScoopWhoop approaches Delhi High Court for permanent injunction against infringement of mark ‘VAGABOMB’

Internet media company, ScoopWhoop has filed for permanent injunction before Delhi High Court, against former Editor-in Chief, Gayatri Dahiya for infringing their women-centric content website ‘Vagabomb’. It is submitted that, Gayatri had approached ScoopWhoop for the position of editorial on 25th November, 2014 when they had planned to launch the all-exclusive women-centric webzine. Gayatri had suggested few names out of which the name ‘Vagabomb’ was shortlisted for the webzine and thereafter she had also joined the company as the Editor-in-Chief of the aforesaid webzine.

The mark ‘Vagabomb’ has been in use by ScoopWhoop since the year 2015 and has also secured successful registration under Classes 9 and 35, whereas registration in Classes 38 and 41 is pending. Gayatri, during her notice period had applied for registration of the mark ‘Vagabomb’ as a device mark in Classes 35 and 38, thereby creating a false notion and misrepresenting on social media that she is the owner and creator of the webzine which is deceiving members of trade and resulting in consumer confusion about Vagabomb’s actual source of origin. The Delhi High Court, granted ex-parte ad interim injunction against the defendant restraining her from using the mark ‘Vagabomb’ until next hearing. The next hearing is listed before the Hon’ble Court on 28.08.2021.
