Sanofi India Limited alleges trademark infringement of COMBIFLAM marks

Sanofi India Limited has filed a trademark infringement suit against Ridley Life Science Private Limited to restrain them from using the marks ‘CONCIFLAM’ and ‘CORIFLAM’, which is identically and deceptively similar to the plaintiff’s registered trademark ‘COMBIFLAM’. The trademark ‘COMBIFLAM’, which had been applied for registration in 1984, was granted registration on 28.02.1989, and the plaintiff has been using the mark continuously since then. ‘COMBIFLAM VET’ in the year 2018, ‘COMBIFLAM ICYHOT’ and ‘COMBIFLAM, PAIN GONE, ZINDAGI (LIFE) ON’ in the year 2019 on under Class 5 in India respectively. The sale figures of the plaintiff services and products in India are 1918.90 million approximately. In February 2021, the plaintiff came across the mark ‘CONCIFLAM’ concerning pharmaceutical medicines on the website of ‘Ridley Life Sciences’ under the domestic products category. Justice Jayant Nath of the Delhi High Court granted an interim injunction to the plaintiff and restrained the defendants from using the ‘CONCIFLAM’ or ‘CORIFLAM’ mark, similar to the plaintiff’s registered trademark, until further orders.
