Viacom 18 bags injunction to safeguard media rights for broadcasting and communicating La Liga 2021 matches
Recently, in Viacom 18 Media Private Limited vs. www.oreo-tv.com & ors, Hon’ble Mr. Justice Suresh Kumar Rait of the Delhi High Court granted an interim relief on 9 September 2021 to Viacom 18 Media Private Limited for protecting its media rights to broadcast and communicate La Liga 2021 matches. The plaintiff owns and operates the VIACOM 18 Network of channels. It contended that it holds the exclusive right, digital rights, and license in the geographical region to transmit La Liga 2021 via digital platforms through the internet and mobile delivery technology. Also, the plaintiff had the authority to grant the license to third parties to retransmit the La Liga 2021 on commercial terms. Broadcast without prior permission from the plaintiff will amount to an infringement of the plaintiff’s exclusive rights in La Liga 2021, harming the plaintiff’s capacity to monetize the Media Rights through digital platforms. The plaintiff prayed to the Hon’ble Delhi High Court to grant an interim injunction restraining the defendants from infringing the copyright owned by the plaintiff in the upcoming Spanish Football League or La Liga 2021.
After hearing and considering the plaint and material on record, the Court passed an order restraining defendants, their partners, proprietors, officers, servants, agents and representatives, franchisees, head-ends and all others incapacity of principal or agent, acting for and on their behalf from broadcasting, communicating, telecasting, to subscribers or otherwise, through any means, the LA Liga 2021, whether through the plaintiffs Channels or platform or any other channel; transmitting , communicating to public , making available any match, footage, clip, audio-video, audio-only and , or any part of the La Liga 2021, including live score updates, play-by-play and, or textual and, or audio-only commentary, through any website; reproducing, making sound and, or visual recordings of the Plaintiff Channels communicating the same to the public without authorization of the plaintiff; or doing any other thing as is likely to lead to infringement of the exclusive rights of the plaintiff in the La Liga 2021.
