Nestle secures injunction in relation to trademark violation and counterfeit of ‘Maggi’ and ‘Maggi 2-Minute Noodles

In the current case of Societe Des Produits Nestle SA & Anr. v/s Sagar Store & Ors., there are several facts mentioned regarding the Maggi- two-minute noodle. Nestle holds all the trademarks and copyright of Maggi noodles since 1974. The present lawsuit is filed as a suit requesting a permanent injunction order from the court to instruct the defendants to stop using the “Maggi” name and the logo as plaintiffs have exclusive rights. The various submission by the learned counsel of the plaintiffs has established prima facie.

As of 22.06.2021, the plaintiffs found out that the defendants were supplying and manufacturing counterfeit “Maggi” packets through the help of a private investigation. The counsel further submits that these products are manufactured in unhygienic conditions and can cause significant harm to the health and well-being of the consumers who buy these products on the belief that they are genuine. The court in the order restricted the defendants to manufacture further, supply, and distribute the Maggi- Two-minute noodle.

Further, two court commissions were appointed for the seizure of the counterfeit Maggi packets. The costs are to be borne by the plaintiffs. The court will provide 75,000 rupees to court commissioners and further after the report is submitted. The application additionally stands disposed.
