Eureka Forbes seeks injunction from infringement of ‘Aquaguard’ and related marks

Eureka Forbes Limited filed an application seeking ex-parte injunction against National Internet Exchange of India and Ors. to restrain them from infringing their identical registered trademarks and copyrights of marks which include ‘Aquaguard’, ‘Dr. Aquaguard’, ‘Forbes’, ‘Aquasquare’and ‘Aeroguard’. The ‘Aquaguard’ which is India’s first super brand water purifier has been in market since the year 1981. This case has been initiated by Eureka Forbes after receiving various complaints from different parts of India regarding fraudulent

websites which are in operation using their well-known corporate name ‘Eureka Forbes’ and various other registered trademarks. The websites include services for repairing, service and installment of water purifiers, air purifies and vacuum cleaners manufactured by the plaintiff. Not only this, whenever any customer types ‘Aquaguard Customer Support/Aquaguard Service Centre’ or for any help regarding the plaintiff’s products, the infringing websites belonging to the defendants are being reflected to customers. Justice Jayant Nath of Hon’ble Delhi High Court restrained the defendants from using/displaying the plaintiff’s corporate name or related registered trademarks/copyrights or any similar marks in any manner whatsoever.
