Trademark dispute regarding mark ‘BEARDO’

The owner of brand ‘BEARDO’, Zed Lifestyle Pvt. Ltd. had alleged Hardik Mukeshbhai Pansheriya & Ors. of infringing their registered trademark ‘‘BEARDO’ as well as passing off their goods as goods of theirs. The plaintiff is holder of registration of the ‘BEARDO’ word and label mark in respect of ‘bleaching preparations and other substances for laundry use, cleaning, polishing, face wash, hair oil’ etc. which are valid and subsisting till date in almost 18 different classes. The plaintiff has an agreement with amazon.in to display its products on their website under the name

BEARDO STORE’ but on conducting a search using the word ‘BEARDO’ the website is showing the defendants products as well dealing with ‘distilled water for batteries, toilet cleaner fluid and many others’, which have zero resemblance with the plaintiff’s products. The defendants have secured registrations of word mark ‘BEARDO’ in Classes 7 and 11. This is a clear example of misrepresentation and fraud of the highest order by the defendant as they are not only infringing the registered trademarks of the plaintiffs but also seeking to capitalize on their goodwill to the extent of falsely representing to the public, that the defendant’s products are also sold on the ‘BEARDO STORE’ website.

‘The Delhi High Court granted an ex parte ad interim relief to the plaintiff to prevent further infringement of their registered trademarks and restrained the defendant from using the mark ‘BEARDO’ or any identical/deceptively similar mark and further ordered them to remove the impugned list of products lists under the ‘BEARDO’ mark from every website on internet. The matter is listed for hearing on 28th July, 2021.
