Bombay High Court rules in favor of Prince Pipes in trademark infringement case

Prince Pipes and Fittings Limited had filed a suit against Platinum Pipes and Fittings, Vigor Plast India Private Limited and Dhananjay Brass Products seeking injunction for infringing their registered trademark “PRINCE”. This trademark has been in use since the year 1996 and has earned strong goodwill and reputation among consumers of trade. Prince Pipes stated that they do not sell any product under the name of “Prince Platinum” and sell of such counterfeit products by Platinum Pipes is leading to confusion in the minds of consumers and is an obvious attempt to trade upon the goodwill of Prince Pipes.

To avoid this confusion there is a need for grant of injunction against Platinum Pipes. Bombay High Court on 10th March, 2021 granted an ad-interim injunction against Platinum Pipes stating that considerable damage has already been caused to Prince Pipes and any further damage should be avoided. The Hon’ble Court also appointed court receiver to carry out search and seizure at the business premises of Platinum Pipes in Jamnagar and found out that huge scale of operation of manufacturing and processing of counterfeit products was underway in Jamnagar.
