Shanghai High Court rules in favor of FENDI for trademark infringement

Capital Outlets Commercial Development rented nine stores to Shanghai Yilang International Trade to sell products from famous Italian luxury brand Fendi. This came to Fendi’s knowledge a year later, that one of those nine stores used its trademark on their store signs, packages, receipts and brochures, without their due permission. Before Fendi appealed to the High Court, a local-district level court had ruled in favour of the defendants as they had stated that they were not selling any counterfeit products.

Shanghai Intellectual Property Court reversed the judgement and ruled in favour of Fendi stating the defendants to pay an amount of ¥350,000 in penalty for use of Fendi’s well-known trademark. The Hon’ble High Court in its order stated that there are two models for luxury goods i.e., selling products in brand-operated stores managed by the brand itself or selling of products in integrated stores with due permission of the brand.
