Infringement suit filed by Decathlon Sports against Pentathlon Sports

Decathlon Sports, a France-based company having more than 70 stores in India, have filed an infringement suit against Pentathlon Sports in Ghaziabad District Court, having three retail stores in NCR-region of India. The infringement suit has been filed to stop Pentathlon sports from selling substandard products in the market and passing off their goods/services as that of Decathlon Sports. even italicized the same alphabet in their brand name similar to that of the Plaintiff. Pentathlon Sports have however refuted the claims and stated that they have used the word ‘Everyone’ in their brand tagline which states ‘Sports for Everyone- Everyone for Sports’ and that they have italicized two conjoined alphabets “CA” in their brand name making it different from Decathlon Sports. In the lawsuit, Decathlon have further claimed that they have suffered irreparable damage due to the unauthorized use of the deceptively similar trademark by Pentathlon Sports and that it is clearly banking on the reputation and goodwill of Decathlon’s brand.
